1.1 These Terms of Service govern your access to and use of the PharmaSolve website and AI-powered communication services ("Services") provided by PharmaSolve ("we", "our", "us").
By accessing or using our Services, you agree to be bound by these Terms.
1.2 For the purposes of these Terms, AI Services means the conversational artificial intelligence, virtual reception and related communication services provided by PharmaSolve on behalf of participating pharmacies.
1.3 These Terms should be read alongside our Privacy & Data Protection Policy, AI Call Handling & Recording Policy, Website Terms of Use and any separate commercial agreement entered into between PharmaSolve and a participating pharmacy.
2.1 PharmaSolve provides AI-powered communication services designed to assist pharmacies by answering telephone enquiries, routing calls, collecting messages, sending SMS communications and providing information supplied by participating pharmacies.
2.2 PharmaSolve is a technology platform only.
Our Services are intended to support pharmacy operations and customer communications. They are not designed to replace pharmacists, healthcare professionals or clinical judgement.
3.1 Our AI Services are designed to provide general information about a participating pharmacy based on information supplied by that pharmacy.
3.2 Where a pharmacy configures PharmaSolve to perform actions such as routing calls, collecting messages or sending SMS communications, those actions are deemed to have been authorised by the participating pharmacy.
3.3 Customers remain responsible for ensuring that the information provided to PharmaSolve is accurate, complete and kept up to date.
4.1 Responses generated by PharmaSolve use artificial intelligence and may not always be complete, accurate or appropriate in every circumstance.
4.2 Customers and callers should independently verify important information before relying upon AI-generated responses.
4.3 PharmaSolve does not guarantee the accuracy, completeness or suitability of every AI-generated response.
5.1 PharmaSolve does not provide medical advice, diagnose medical conditions, prescribe medication or replace advice from a qualified healthcare professional.
5.2 Where appropriate, callers should speak directly with a pharmacist or other qualified healthcare professional.
5.3 In the event of a medical emergency, callers should immediately contact 111 or seek urgent medical assistance.

7.1 All intellectual property rights relating to the PharmaSolve platform, software, branding, AI workflows and documentation remain the property of PharmaSolve or its licensors.
7.2 Users must not copy, reproduce, reverse engineer or otherwise exploit any part of the PharmaSolve platform except where permitted by law or authorised by PharmaSolve.
8.1 PharmaSolve aims to provide a reliable and secure service; however, uninterrupted availability cannot be guaranteed.
8.2 Services may occasionally be unavailable due to maintenance, system upgrades, telecommunications issues, internet outages or circumstances beyond our reasonable control.
8.3 We may update, improve, modify or discontinue features from time to time to improve the security, performance or functionality of the platform.
9.1 PharmaSolve uses trusted third-party technology providers to deliver elements of the Services, including cloud infrastructure, telecommunications, SMS delivery and artificial intelligence processing.
9.2 While we carefully select these providers, we cannot guarantee the performance or availability of services outside our direct control.
10.1 The collection, storage and use of personal information is governed by our Privacy & Data Protection Policy.
10.2 Where PharmaSolve processes information on behalf of a participating pharmacy, the pharmacy remains responsible for complying with its legal obligations regarding patient information.
11.1 To the maximum extent permitted by law, PharmaSolve makes no warranties or guarantees regarding the accuracy, completeness, availability or suitability of AI-generated information.
11.2 PharmaSolve shall not be liable for any loss, damage or liability arising from the use of, or inability to use, the Services, except where liability cannot lawfully be excluded under New Zealand law.
11.3 Nothing in these Terms limits any rights available under the Consumer Guarantees Act 1993 or other applicable legislation where those rights cannot legally be excluded.
12.1 We may amend these Terms from time to time to reflect changes in our Services, technology or legal obligations.
12.2 Updated Terms will be published on our website together with the revised effective date.
Continued use of the Services after updated Terms have been published constitutes acceptance of those changes.
